Confirmation of booking  

A registration is not confirmed until full payment is made. Registration will be considered tentative pending receipt of full payment within fourteen (14) days. Harcourts International Limited (or its subsidiaries as the case requires) reserves the right to cancel any tentative registrations and, without further notice, reallocate the registration to other interested parties.

 

Late registrations  

Registrations made after 18 August 2023 may incur additional fees due to increased hotel rates and NAR Conference Ticket prices.

 

Tour capacity  

The parties acknowledge and agree that the Harcourts America Study Tour requires a minimum number of 35 delegates for the Harcourts America Study Tour to proceed. If minimum numbers are not achieved, Harcourts International Limited has the right to cancel the tour.

Inclusions and Exclusions

The delegate acknowledges and agrees that the Harcourts America Study Tour has two (2) different packages available which contains varying inclusions and exclusions. Please refer to Book your ticket | Harcourts Study Tour for a complete list of all inclusions and exclusions. For the sake of clarity, anything that is not specified as being included in the relevant package will be excluded and will be at the Delegate’s additional costs (such as flights, accommodation (where applicable), travel insurance, spending money, food (where applicable) and other incidentals. Delegates must pay for their own additional accommodation expenses and incidental expenses, unless alternative arrangements are made with Harcourts International Limited in writing. Should any delegates depart without paying for any additional accommodation or other expenses incurred, the delegate’s credit card on file will be charged upon returning to Australia.

Changes to room requirements after registering may incur additional fees and will be subject to the terms and conditions of the accommodation provider.

If hotel changes it will be to an equivalent standard.

Cancellation Policy

  • All registrations must be completed at Home | Harcourts Study Tour

  • All registrations include a $1,000 non refundable deposit 

  • Cancellations received on or before 28 August 2023 will receive a full refund minus the deposit

  • Cancellations received after 28 August 2023 will receive NO REFUND
    A replacement delegate will be accepted up until  31 October 2023 for all registrations. Any fees caused due to a change in name will be at the delegate’s expense.

  • If the event is cancelled by Harcourts International Limited due to the unlikely event of an earthquake, flood, or other natural disaster, delegates will receive a full refund of their registration payments.
     

Transfer of registration  

Upon written request, any transfers of registrations will be at the discretion of Harcourts International Limited and may incur additional charges.

Personal contact details  

In registering for this event, delegates acknowledge that any confidential or personal information provided by delegates to or is collected by Harcourts International Limited in connection with the Harcourts America Study Tour will, subject to the below clause, be dealt with by Harcourts International Limited in accordance with its privacy policy which is available at https://harcourts.com.au/content/privacypolicy.

Furthermore, Harcourts International Limited may record or use any information delegates provide for the purpose of conducting the Harcourts America Study Tour, including but not limited to providing those details to any sponsors, exhibitors, designers, printers, venues, tour providers, accommodation providers or any other third parties associated with the Harcourts America Study Tour.  Should you wish 'opt-out' from your details being passed on to such third parties, please advise Harcourts in writing events@harcourts.net.

Travel insurance and visas  

Delegates are responsible for arranging their own travel insurance cover for the duration of the Harcourts America Study Tour. Harcourts International Limited will not be liable to the delegate for any failure to obtain necessary travel insurance.

Delegates are responsible for arranging their own Electronic System for Travel Authorisation (ESTA) to be able to enter the United States under the Visa Waiver Program.

As per the Australian Government Civil Aviation Safety Authority (CASA), delegates travelling on the Harcourts America Study Tour must have a minimum six-month validity left on their passport at the time of departing Australia.

Itinerary  

Every effort will be made to deliver the advertised program, however, the content of the tours and days’ activities scheduled are subject to change.

Where replacement tours are required, they will be of the same quality and consistent with the intent of the Harcourts America Study Tour.

​

Catering services  

Harcourts International Limited will coordinate those meals that have been included in the cost of your registration. Attendees are welcome to bring additional food and beverages with them on-site tours but will be subject to the venue provider’s terms and conditions.

​

Special Dietary Requirements 

Please notify us upon registration for any special dietary requirements.

Harcourts International Limited will do its best to accommodate any dietary requirements submitted after this time, however, will be subject to the terms and conditions of the food and beverage provider.

​

Security and conduct  

Harcourts International Limited upholds the principles of Responsible Service of Alcohol and reserves the right to refuse service of alcohol to persons suspected of being under the age of 21years who cannot procure appropriate evidence to the contrary, and to any persons who show signs of intoxication. You acknowledge that Harcourts International Limited has the right to remove the offending delegate/s from the activity. 

Excessive drinking will not be tolerated. Delegates may be asked to leave events if they are believed to have excessively consumed alcohol.

By attending the Harcourts America Study Tour, you agree to follow any lawful instruction provided by Harcourts International Limited staff, and or other provider’s staff. All delegates agree to comply with the conditions of entry to all venues, hotels, airlines, transport and other suppliers.

Harcourts International Limited reserves the right to prohibit travel on the Harcourts America Study Tour to persons who have not agreed to the Terms and Conditions.

Delegates are asked to bring any dangerous behaviour or conditions throughout the Harcourts America Study Tour to the attention of Harcourts International Limited staff and other parties staff members.

Personal Belongings  

Equipment, laptop computers, bags or other valuables must not be left unattended. It is the responsibility of all delegates to ensure that valuables are secured during breaks or at the end of the day. Harcourts International Limited will not be liable to delegates for any loss or damage to personal belongings.

​

Internet and Telephone 

Some hotels and venues may have free Wi-Fi available. Should delegates require additional download capacity and/or Wi-Fi that is not publicly available, this will be at the cost of the delegate.

It is recommended that delegates activate international roaming to receive calls overseas so that they can be contacted in an emergency. Please note that mobile plans do not usually cover making and receiving calls, data usage, voicemail, SMS and MMS while overseas, so extra charges may be incurred. Again, such charges will be the responsibility of the delegate.

Weather  

Attendees are encouraged to consume bottled water to avoid dehydration and dress appropriately according to weather conditions. In the event of inclement weather or force majeure (war, revolution, act of public enemies or act of terrorism; riot, blockade, insurrection or civil commotion; strike, lockout, stoppage, ban or limitation on work, restraint of labour or other industrial dispute; act of god; epidemic or disease; fire, flood, earthquake, storm or cyclone; malicious damage, smoke or explosion; sabotage, bomb threat, or other threats of violence; act or restraint of any government or semi-governmental or other public statutory authority; judgement, ruling decisions or enforcement actions of any court or tribunal jurisdiction; breakdown of any facilities or machinery or unavailability of essential equipment, supplies or services; cessation of or interruption to water or electrical supply) or any other cause or event not reasonably within the control of Harcourts International Limited which may affect the event in whole or in part, refunds will be based on the individual circumstances and venue policies.

Image Release


In registering for the Harcourts America Study Tour, delegates:

  1.    acknowledge and agree that photographs or audio or video recordings containing the image, voice or likeness (Recordings) of delegates (including you) may be taken, captured, or made by Harcourts International Limited or any officer, director, employee, agent, subcontractor, or volunteer of Harcourts International Limited (Personnel);

  2.    give unconditional and irrevocable consent for Harcourts International Limited and its Personnel to use the Recordings and any information previously provided by delegates to Harcourts International Limited (including any personal information or other content) (Content) in perpetuity without restriction as to changes or alterations, and to disclose any personal information that is contained in any Recording or Content, to any person and via any medium for promotional, news, on-line/multimedia, research and/or educational purposes or otherwise for the purposes of providing delegates with promotional offers, special catering, and physical requirements, name tag creation, event options or any other matter which Harcourts International Limited may deem relevant to the Harcourts America Study Tour;

  3.     acknowledge and agree that delegates are not entitled to any remuneration, royalties or any other payment from Harcourts International Limited in respect of the use of any Recordings or Content;

  4.    acknowledge and agree that as between delegates and Harcourts International Limited, Harcourts International Limited is the sole legal and beneficial owner of all intellectual property rights in and attaching to any Recordings and consent on an irrevocable, worldwide, and perpetual basis, to the infringement of all moral rights delegates may have in and to any such Recordings;

  5.    acknowledge and agree that Harcourts International Limited may assign or transfer the benefit of the consent given under these conditions to any person; and

  6.     release, discharge, and hold harmless, Harcourts and its Personnel from any, and all liability for any expenses, costs, liabilities, claims, actions, proceedings, damages, judgments, and losses of any kind whatsoever (including consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) (Losses) that they may hereafter have by reason of anything contained in the Recordings or Content. Should a delegate not agree to these conditions, they must advise Harcourts in writing events@harcourts.net.
     

Liability


Delegates acknowledge and agree that their attendance/participation at during the Harcourts America Study Tour is at their own risk. Delegates are advised to effect their own insurance to cover all risks including (but not limited to) costs of travel, accommodation, fees, personal property, health and medical expenses, injury, death, and all other risks. Delegates hereby release and hold harmless Harcourts International Limited and its Personnel from any liability for any losses suffered by delegates in relation to their participation in the event (including for the avoidance of doubt travel to and from the Harcourts America Study Tour). Nothing in this clause limits or excludes liability: (a) for personal injury or death caused by negligence; (b) for fraud; or (c) to the extent such limitation or exclusion is not permitted by applicable law, and such terms are severable and do not invalidate the remaining terms.

To the extent permitted by the law, delegates indemnify Harcourts International Limited and its Personnel against any Losses incurred or suffered by any of them which arise out of, are caused by, are attributable to or result from any breach of these terms and conditions, breach of any warranty or any wrongful or negligent act or omission by the delegate.


Responsibility


Harcourts will use reasonable efforts to ensure that delegates' attendance at the Harcourts America Study Tour will be as comfortable and enjoyable as possible.  Harcourts provides the Harcourts America Study Tour on the condition that Harcourts International Limited, its employees, delegates, agents, and sub-contractors cannot be held liable for any loss, damage, or inconvenience, however arising, experienced by delegates during the Harcourts America Study Tour, including while travelling to or from the event venue, hotel and their office/home location.

COVID-19

 

The safety of delegates, attendees, and staff is of paramount importance, and Harcourts has requested that the relevant venue provider/s take necessary steps to minimize the potential spread of COVID-19. Delegates acknowledge that if at the time of the Harcourts America Study Tour any government regulations or restrictions related to COVID-19 limit or prohibit the ability of delegates to attend, Harcourts International Limited reserves the right to postpone or cancel the Harcourts America Study Tour. Harcourts International Limited will refund any registration fees where the event is cancelled, however, any registration fees will be transferred to that new date where the event is postponed.

Notwithstanding the above, Delegates acknowledge the contagious nature of COVID-19 and further acknowledge that in no way does Harcourts International Limited or the venue provider/s in any way provide any warranty or representation that Delegates will not become infected with COVID-19 by attending the event. Accordingly, Delegates understand that there is a risk of becoming exposed to and/or infected by COVID-19 whilst attending the event as a result of the actions, omissions, or negligence of the delegate or other attendees, including, but not limited to, Harcourts International Limited staff, venue staff, and third parties. Attendance at the Harcourts America Study Tour is at the delegate's own risk. Delegates agree to strictly comply with all venue provider’s, relevant State Government’s or Harcourts International Limited policies, procedures, instructions and directions while attending the event.

 

Delegates further acknowledge and agree:

* that Delegate has not been diagnosed with Covid-19 at the time of the Harcourts America Study Tour and/or is not experiencing any symptoms of illness such as a cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell immediately prior to attending the event. Delegate agrees not to attend the event whilst experiencing such symptoms.

* that Delegate may be required to be double-vaccinated to enter the venue and may be required to show proof of vaccination. In the event Delegate has not been vaccinated or is unable to provide proof of vaccination, Delegate may be refused entry to the Harcourts America Study Tour;

* to comply with any mask mandates or social distancing requirements issued by the venue provider or relevant State Government in place at the time of the Harcourts America Study Tour;

* Delegate has not travelled to any Covid-19 hotspots, within the last 14 days prior to the Harcourts America Study Tour;

* Delegate and/or a household member has not been a close contact with a confirmed Covid-19 case within 14 days prior to the Harcourts America Study Tour or Delegate has not been required to self-isolate or quarantine as required by any government direction.

* Delegate does not believe they have been exposed to someone with a suspected and/or confirmed case of COVID-19, or who has travelled internationally, or returned to Australia from overseas, within 14 days prior to the event.

* Delegate has not been diagnosed with Covid-19 and not yet cleared as non-contagious by health authorities.

* Delegate is following all recommended guidelines as much as possible and limiting exposure to COVID-19.

 

Delegate hereby releases Harcourts International Limited, its officers, and employees from all liability, causes of action, claims, demands, damages, costs (including the cost of treatment), expenses, and compensation for injury (including death) arising out of any contraction by Delegate of COVID-19, or any other virus, whilst attending the Harcourts America Study Tour. Delegate also hereby indemnifies Harcourts International Limited and agrees to hold them harmless from all liability, causes of action, claims, demands, damages, costs (including the cost of treatment), losses, expenses, and compensation for injury (including death) arising out of the contraction by any person of COVID-19, or any other virus, whilst attending the Harcourts America Study Tour where such action can be traced back to delegate's actions or omissions.

General

 

  1.     Delegates acknowledge that Harcourts International Limited may withdraw your right to participate in or otherwise cancel the Harcourts America Study Tour at any time in its absolute discretion and that any such decision by Harcourts International Limited will be final and binding and no correspondence will be entered into in this regard. Should this occur, Harcourts International Limited will provide delegate/s with a full refund of their event registration payments, and to the extent permitted by law, Harcourts International Limited will not be liable to delegates for any other Losses suffered.

  2.    If any provision or part of a provision of these terms and conditions can be read in a way that makes it illegal, unenforceable, or invalid, but can also be read in a way that makes it legal, enforceable, and valid, it must be read in the latter way.

  3.    Should any provision of these terms and conditions be held to be unenforceable, such provision will be deemed severed from these terms and conditions without affecting the enforceability or validity of the remaining provisions which shall continue in full force and effect.

  4.    Harcourts International Limited reserves the right to make amendments to these terms and conditions from time to time at its sole discretion and without notice. 

  5.    These terms and conditions are governed by the laws of Queensland, Australia and Harcourts International Limited and all delegates irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland and waive any objection to the venue of any legal process in these courts on the basis that the process has been brought in an inconvenient forum.
